This Privacy Policy explains how Funsly ("we", "us", "our") collects, uses, stores, and shares your personal information when you use the Funsly platform ("Service"). By using the Service you consent to the practices described herein.

1. Information We Collect

  • Registration data: name, date of birth, gender, email, phone number, and hashed password.
  • Profile data: photographs, biography, interests, relationship preferences, and other voluntary information.
  • Location data: approximate geographic location to display nearby profiles. Precise GPS is not persistently stored.
  • Usage data: interactions, session timestamps, device type, IP address, and app version.
  • Payment data: transaction identifiers and amounts. Full payment card numbers are never stored by us.
  • Communications: messages sent through the Service are stored to enable delivery and retained per Section 4.

2. How We Use Your Information

We use your data to: operate and provide the Service; display your profile to other users; personalise match recommendations; process payments; send service-related communications; investigate abuse reports; improve platform performance; and comply with legal obligations.

3. Sharing of Information

We do not sell your personal data. We may share data with: other users (your public profile information); service providers under strict data processing agreements; law enforcement when required by applicable law; and successor entities in the event of a business transfer.

4. Data Retention

We retain your data while your account is active. After account deletion, personal data is deleted or anonymised within 30 days, except where retention is required for legal obligations or fraud prevention (up to 3 years).

5. Security

We implement industry-standard security measures including TLS encryption in transit and encryption at rest. However, no system is 100% secure. WE CANNOT GUARANTEE ABSOLUTE SECURITY AND SHALL NOT BE LIABLE FOR UNAUTHORIZED ACCESS, DATA BREACHES, OR LOSS OF DATA BEYOND OUR REASONABLE CONTROL.

6. Your Rights

Depending on your jurisdiction, you may have rights to access, correct, delete, restrict, or port your personal data. Contact privacy@funsly.app to exercise these rights. We respond within 30 days.

7. International Transfers

Your data may be processed in countries other than your country of residence. We take appropriate safeguards to comply with applicable data protection law.

8. Children

The Service is not directed at persons under 18. We do not knowingly collect data from minors.

9. No Liability for Third-Party Breaches

While we implement reasonable security measures, we expressly disclaim liability for data breaches caused by third-party actors, zero-day exploits, or events outside our control. Your use of the Service constitutes acceptance of these inherent risks.

Mandatory Legal Notice

  • 18+ only. The Service is strictly limited to users who are 18 years of age or older. By registering, accessing, or using Funsly, you represent and warrant that you are at least 18 years old and legally able to enter this agreement. Any underage access is unauthorized and may result in account removal.
  • AI-generated or AI-assisted content. Profiles, messages, reply suggestions, translations, compatibility scores, recommendations, images, blog posts, moderation outputs, support responses, and any other content or feature made available through the Service may be created, assisted, translated, modified, ranked, or displayed with artificial intelligence and automation. Such content may be inaccurate, incomplete, offensive, unexpected, or unsuitable for your purposes.
  • User responsibility and no platform liability. Users are solely responsible for their own content, conduct, communications, purchases, meetings, decisions, and interactions. Funsly, its owners, developers, operators, support team, infrastructure providers, affiliates, and service providers do not endorse, verify, control, or assume responsibility for user content or user actions and disclaim all liability for them to the maximum extent permitted by applicable law.
  • Payments are final and internal-use only. All funds, wallet top-ups, coins, credits, subscriptions, paid unlocks, gifts, boosts, and other paid features purchased or added through the Service are final, non-refundable, non-transferable, have no cash value, and may be used only inside the Funsly system, except only where a mandatory non-waivable law requires otherwise.

AI Processing and Adult Eligibility

Some Service features may process profile, message, image, usage, safety, and support data with automated or AI-assisted tools to operate, translate, personalize, moderate, secure, or improve the Service. The Service is not intended for anyone under 18.
