PLEASE READ THIS DISCLAIMER CAREFULLY. BY USING THE FUNSLY PLATFORM ("SERVICE") YOU ACKNOWLEDGE AND ACCEPT THESE TERMS IN FULL. IF YOU DO NOT ACCEPT THEM, STOP USING THE SERVICE IMMEDIATELY.

1. No Warranties — "As Is" and "As Available"

Funsly ("the Company", "we", "us", "our") provides the Service strictly on an "as is" and "as available" basis. We make no representations, warranties, or guarantees — express, implied, or statutory — regarding: the operation or availability of the Service; the accuracy or reliability of any information displayed; the conduct or identity of any user; or the outcome of any interaction facilitated through the Service.

2. Platform as Neutral Technology Intermediary

Funsly is a neutral technology platform. The Company:

  • is not a party to any interaction, conversation, meeting, or transaction between users;
  • does not screen, verify, or vouch for any user's identity, intentions, or representations;
  • does not monitor, endorse, or take responsibility for user-generated content;
  • is not responsible for physical, emotional, psychological, financial, or any other harm arising from user interactions, whether online or offline;
  • provides access to the platform as a tool only — what users do with that tool is entirely their own responsibility.

THE COMPANY'S ROLE IS LIMITED TO PROVIDING TECHNOLOGY INFRASTRUCTURE. ALL RESPONSIBILITY FOR HOW THE SERVICE IS USED RESTS SOLELY WITH THE INDIVIDUAL USER.

3. No Liability for Service Disruptions or Data Loss

We do not guarantee that the Service will be available at any particular time. The Service may be interrupted by maintenance, technical failures, cyberattacks, force majeure, or any other reason. WE SHALL NOT BE LIABLE FOR ANY LOSS, COST, OR DAMAGE — INCLUDING LOSS OF REVENUE, LOSS OF DATA, LOSS OF VIRTUAL CURRENCY, OR LOSS OF ACCOUNT ACCESS — CAUSED BY UNAVAILABILITY OF OR ERRORS IN THE SERVICE, FOR ANY REASON WHATSOEVER.

4. No Liability for User Content

All content posted by users represents the views and actions of the individual user only. The Company exercises no editorial control over user content and expressly disclaims all liability for any content created, posted, or transmitted by users. Users who encounter offensive or unlawful content should use the in-app reporting feature.

5. No Liability for Financial Loss

THE COMPANY SHALL NOT BE LIABLE FOR ANY FINANCIAL LOSS OF ANY KIND, including but not limited to: loss of virtual currency (Coins); subscription fees paid; gifts purchased; losses arising from account suspension or termination; losses from technical errors or payment processing failures; or losses caused by fraud or unauthorized conduct by other users or third parties. All financial transactions are undertaken at the user's sole risk.

6. No Liability for User Interactions or Outcomes

The Company accepts no responsibility for the outcome of any user interaction, whether romantic, social, or otherwise. Any decision to communicate with, meet, or engage with another user is made entirely at the user's own risk. The Company has no involvement in, and accepts no liability for, what takes place between users during or after the use of the Service.

7. No Liability for Third-Party Services

The Service integrates with third-party payment processors and service providers. We are not responsible for the content, availability, security, or actions of any third party. Use of third-party services is entirely at the user's own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY'S TOTAL AGGREGATE LIABILITY TO ANY USER FOR ALL CLAIMS ARISING OUT OF OR RELATING TO USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY THAT USER IN THE THREE MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS (USD 50). THIS CAP APPLIES REGARDLESS OF THE FORM OF ACTION AND EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

By using the Service, you agree to indemnify and hold harmless the Company, its affiliates, officers, directors, employees, and agents from and against any and all claims, losses, damages, liabilities, costs, and expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your interaction with other users.

10. Jurisdiction-Specific Limitations

Some jurisdictions do not permit the exclusion of certain implied warranties or limitations of liability. Where mandatory law applies, our liability is limited to the maximum extent permitted. Nothing in this Disclaimer is intended to override statutory rights you hold under mandatory consumer protection legislation in your country of residence.

11. Acceptance

By using the Service you confirm that you have read, understood, and accepted this Disclaimer, together with our Terms of Service and Privacy Policy.

Mandatory Legal Notice

  • 18+ only. The Service is strictly limited to users who are 18 years of age or older. By registering, accessing, or using Funsly, you represent and warrant that you are at least 18 years old and legally able to enter this agreement. Any underage access is unauthorized and may result in account removal.
  • AI-generated or AI-assisted content. Profiles, messages, reply suggestions, translations, compatibility scores, recommendations, images, blog posts, moderation outputs, support responses, and any other content or feature made available through the Service may be created, assisted, translated, modified, ranked, or displayed with artificial intelligence and automation. Such content may be inaccurate, incomplete, offensive, unexpected, or unsuitable for your purposes.
  • User responsibility and no platform liability. Users are solely responsible for their own content, conduct, communications, purchases, meetings, decisions, and interactions. Funsly, its owners, developers, operators, support team, infrastructure providers, affiliates, and service providers do not endorse, verify, control, or assume responsibility for user content or user actions and disclaim all liability for them to the maximum extent permitted by applicable law.
  • Payments are final and internal-use only. All funds, wallet top-ups, coins, credits, subscriptions, paid unlocks, gifts, boosts, and other paid features purchased or added through the Service are final, non-refundable, non-transferable, have no cash value, and may be used only inside the Funsly system, except only where a mandatory non-waivable law requires otherwise.

No Responsibility for AI or User Content

Content available through the Service may be produced by users, third parties, automated systems, or AI tools. Funsly does not guarantee that any such content is accurate, lawful, safe, authentic, available, or suitable, and does not accept responsibility for reliance on it or for any user action taken because of it.
